1. Acceptance of Terms

By creating an account or using Zareva, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the app. These Terms form a binding contract between you and BDKM LLC, a Washington limited liability company ("BDKM," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age to create an account and use Zareva. By using the app, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are managing medications for a minor or another adult, you represent that you have the legal authority to do so (e.g., parent, legal guardian, or authorized caregiver), and the account must be in your name.

3. What Zareva Is

Zareva is a wellness companion and medication reminder tool. It helps you track your medication schedule, set reminders, log daily wellness check-ins, track prescription refills, schedule doctor appointments, and share wellness information with caregivers you choose.

Zareva is designed for personal wellness management. It is NOT a medical device, healthcare provider, pharmacy, or insurance service. Zareva is NOT a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), and information you store in Zareva does not receive HIPAA protections. We voluntarily apply HIPAA-aligned security practices (encryption at rest and in transit, access controls, minimum data collection) but you should not assume HIPAA rights apply to your use of the app.

4. Important Disclaimers

This app is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.

Always consult your doctor or pharmacist for medical advice.

Notification delivery is not guaranteed. You are responsible for your medication adherence.

5. What Zareva Does Not Do

Zareva does not calculate or recommend medication dosages
Zareva does not diagnose conditions or suggest changes to your medication regimen
Zareva does not replace professional medical advice, diagnosis, or care
Zareva does not guarantee notification delivery — device settings, battery optimization, operating system behavior, and network conditions may delay or prevent reminders
Drug interaction information is provided for informational purposes only, may not be complete or current, and may produce false negatives. Never rely solely on Zareva to identify drug interactions — always consult your pharmacist
Zareva does not connect to or control medical devices

6. Your Account

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You are solely responsible for all activity that occurs under your account.

You may delete your account at any time from Settings → Account → Delete Account. All your data will be permanently removed within 45 days, consistent with the Washington My Health My Data Act. For detailed instructions, see our account deletion page.

7. Subscriptions, Free Trials & Refunds

Zareva offers unlimited medication tracking and reminders for free. Some additional features require a paid subscription (Plus or Circle tier).

Subscriptions auto-renew at the end of each billing period at the then-current price unless cancelled at least 24 hours before the renewal date. Free trials, if offered (currently 7 days for new subscribers), automatically convert to paid subscriptions at the end of the trial period unless cancelled before the trial ends.

You manage and cancel subscriptions through your device's app store (Apple App Store: Settings → [Your Name] → Subscriptions; Google Play: Play Store → Profile → Payments and subscriptions → Subscriptions). Refunds, when offered, are governed by the policies of the App Store or Play Store where you made the purchase. BDKM does not process refunds directly.

Subscription pricing and features may change. We will notify you of material changes affecting your active subscription before they take effect.

8. Third-Party Services & Affiliate Links

Zareva provides links to third-party services such as GoodRx, EzRx, Amazon, and manufacturer copay assistance programs. These links are provided for your convenience and potential savings.

When you visit an external service, your medication name may be visible to that service in the URL. You will always be notified and asked for confirmation before leaving the app.

Zareva may earn affiliate commissions from these services at no additional cost to you. These commissions are disclosed in the app. We are not responsible for the content, privacy practices, availability, pricing accuracy, or any other aspects of third-party services.

Prices, coupons, and savings shown are estimates and may vary by location and pharmacy. Always verify pricing with your pharmacy before making decisions.

9. Caregiver Features & Attestation

If you invite caregivers to your Care Circle, they will be able to view your medication schedules, adherence data, and wellness check-ins as you have configured. You can remove caregivers and revoke access at any time.

When you invite a caregiver, you represent and warrant that you have the right to share the relevant wellness information with that person, and that you consent to our disclosure of your information to them. If you are inviting a caregiver to monitor someone else's medications (such as a parent or dependent), you represent that you have legal authority to do so.

If you accept an invitation to be a caregiver, you agree to use the shared information solely to support the person who invited you. You agree not to use shared wellness information for harassment, manipulation, financial exploitation, or any unlawful purpose.

10. Data Loss & Service Availability

You acknowledge that no software is error-free and that data loss or service interruption may occur due to bugs, network failures, device issues, app store changes, or other causes beyond our reasonable control.

BDKM will not be liable to you for any loss, deletion, corruption, or unavailability of your data, medication history, wellness logs, or any other information stored or processed by Zareva, regardless of cause. You are responsible for maintaining your own records of medications and dose history if such records are important to you.

Zareva is provided on a best-effort basis and we do not guarantee uptime, availability, or that the service will be uninterrupted, secure, or error-free.

11. Modified or Compromised Devices

If you install Zareva on a device that has been rooted, jailbroken, or otherwise modified to bypass operating-system security, BDKM cannot ensure the integrity, security, or confidentiality of your data and is not responsible for any data loss, security breach, or other harm resulting from such use.

12. Acceptable Use

You agree not to:

Use Zareva for any unlawful purpose
Attempt to gain unauthorized access to other users' data or accounts
Reverse-engineer, decompile, or disassemble the app, except to the extent applicable law expressly permits
Use automated systems (bots, scrapers) to access the app in a manner that sends more requests than a human could reasonably produce
Interfere with or disrupt the app's infrastructure or other users' experience
Misrepresent your identity, age, or relationship to another user
Resell, sublicense, or commercially exploit Zareva or its content
Submit false, misleading, or harmful information through caregiver features

13. Intellectual Property

Zareva, including its design, code, branding, and content, is owned by BDKM LLC. You may not copy, modify, or distribute any part of the app without our written permission. Your wellness data remains yours — we claim no ownership of the information you enter into the app.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZAREVA AND BDKM LLC ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ANY ACTIONS YOU TAKE BASED ON CONTENT, NOTIFICATIONS, REMINDERS, DRUG INFORMATION, OR ANY OTHER OUTPUT FROM ZAREVA ARE TAKEN AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BDKM LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

MISSED MEDICATIONS due to failed, delayed, or silenced notifications
HEALTH OUTCOMES, INJURY, OR LOSS resulting from reliance on the app
INACCURATE, INCOMPLETE, OR OUTDATED DRUG INTERACTION INFORMATION
ACTIONS TAKEN OR NOT TAKEN based on information provided by the app
LOSS, DELETION, OR CORRUPTION OF DATA
ACTS OR OMISSIONS OF CAREGIVERS
THIRD-PARTY SERVICE availability, accuracy, or pricing
SERVICE OUTAGES OR INTERRUPTIONS

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO ZAREVA SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BDKM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You acknowledge that Zareva is a wellness tool and that all medical decisions must be made in consultation with qualified healthcare professionals. Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of these limitations may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless BDKM LLC and its officers, members, employees, contractors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of Zareva
Your violation of these Terms
Your violation of any third party's rights, including privacy or intellectual property rights
Your role as a caregiver or recipient of caregiver invitations, including any disputes between you and another user
Any false representation about your eligibility, authority, or relationship to another user

16. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

You and BDKM LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Zareva (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law, except that you may bring claims in small-claims court if your claim qualifies.

The arbitration will take place in the State of Washington, or by video or telephone conference at the arbitrator's discretion. The arbitrator's decision will be final and binding.

YOU AND BDKM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

30-Day Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@zareva.app within 30 days of first accepting these Terms. Your notice must include your full name, the email associated with your Zareva account, and a clear statement that you wish to opt out. Opting out does not affect any other provision of these Terms.

If any portion of this Section is found to be unenforceable, the remainder shall remain in effect, except that if the class action waiver is found unenforceable, the entire arbitration agreement will be void.

17. Termination

BDKM may suspend or terminate your access to Zareva at any time, with or without notice, for any violation of these Terms or for any other reason. Upon termination, your right to use the app ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Binding Arbitration) will survive.

18. Force Majeure

BDKM is not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app before the changes take effect. Continued use of Zareva after changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically. The "Last updated" date at the top of this page indicates when these Terms were last revised.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law provisions. Subject to the Binding Arbitration section above, any judicial proceeding permitted under these Terms shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.

21. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy and any subscription terms applicable to your purchases, constitute the entire agreement between you and BDKM regarding Zareva and supersede any prior agreements.
